By downloading, installing, or using VirtuPet ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and VirtuPet. You must be at least 13 years of age to use this App.
VirtuPet is a fitness companion app designed to motivate you to walk more by caring for a virtual pet. You agree to:

The step tracking and health features are for motivational and entertainment purposes only. Always consult a qualified healthcare professional before starting any new fitness routine or if you have concerns about your health. We make no claims regarding health benefits. You use this App at your own risk.

All purchases are processed through Apple's App Store and are subject to Apple's terms and conditions. Prices are displayed in your local currency and may vary by region. Prices are subject to change without notice.
Subscription Terms: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscriptions at any time in your Apple ID Account Settings.
All purchases are made through Apple's App Store. Refund requests must be submitted directly to Apple in accordance with Apple's refund policy. We do not have the ability to process refunds directly.
To request a refund, visit reportaproblem.apple.com or contact Apple Support. Apple will review your request and determine eligibility based on their policies.
Play credits are non-refundable once used. Unused credits will remain on your account.
All content in VirtuPet, including but not limited to graphics, animations, text, user interface, code, virtual pets, sounds, and any other materials, is owned by VirtuPet or its licensors and is protected by copyright, trademark, and other intellectual property laws worldwide.
You may not copy, modify, distribute, sell, lease, or create derivative works based on any part of the App without explicit written permission from VirtuPet. The VirtuPet name, logo, and all related names, logos, and product names are trademarks of VirtuPet.
Your VirtuPet data is stored locally on your device. You are solely responsible for:
We are not liable for any loss of data due to device issues, app deletion, iOS updates, software updates, device theft, or unauthorized access to your device.
We reserve the right to terminate or suspend your access to the App immediately, without prior notice or liability, for any reason including but not limited to breach of these Terms.
Upon termination, your right to use the App will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
We do not warrant that: (a) the App will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the App is free of viruses or other harmful components; or (d) the results of using the App will meet your requirements.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VIRTUPET, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $50 USD, WHICHEVER IS GREATER.
You agree to defend, indemnify, and hold harmless VirtuPet and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:
Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the App shall first be attempted to be resolved through informal negotiation by contacting us at support@virtupet.app.
If the dispute is not resolved within 30 days, either party may initiate binding arbitration. The arbitration shall be conducted in accordance with applicable arbitration rules in the jurisdiction of the United Kingdom.
CLASS ACTION WAIVER: YOU AGREE TO WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION. ANY ARBITRATION WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable. The invalidity of any provision shall not affect the validity of the remaining provisions.
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemic, strikes, shortage of transportation, fuel, energy, labor, materials, or technical failures of third-party services.
We reserve the right to modify these Terms at any time at our sole discretion. We will notify users of material changes through the App or via push notification if you have enabled them.
Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes. If you do not agree to the new Terms, you must stop using the App.
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
You agree to submit to the personal and exclusive jurisdiction of the courts located within the United Kingdom for the resolution of any disputes not subject to arbitration.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and VirtuPet regarding the App and supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether written or oral, regarding the App.
